What is a Title Suit?
A Title Suit (technically a Suit for Declaration under Section 34 of the Specific Relief Act) is filed to seek a legal declaration of ownership over a property. It is often combined with a prayer for 'Permanent Injunction' to prevent the defendant from interfering with the property.
Key Elements of the Plaint
- Description of Property: Detailed schedule of boundaries, area, and location.
- Source of Title: How you acquired the property (Purchase, Inheritance, Gift, etc.).
- Cause of Action: When and how the defendant challenged your title.
- Valuation: Proper court fees must be paid based on the market value of the property.
